These Terms and Conditions (“Terms”) govern your use of services provided by UnfoldTrend (“we,” “our,” or “us”), a game development company located at C-Block, Eden Value Homes, Lahore, Pakistan. By engaging our services or using our website at https://unfoldtrend.com, you (“Client,” “you,” or “your”) agree to be bound by these Terms.
2. Services Description
UnfoldTrend provides Android game development services including but not limited to custom game development, game porting, multiplayer integration, UI/UX design, quality assurance testing, app store optimization, and ongoing maintenance services. The specific scope of services will be detailed in a separate Service Agreement or Statement of Work for each project.
3. Client Responsibilities
Project Requirements You are responsible for providing clear, detailed project requirements, including game concepts, design preferences, functional specifications, and any reference materials necessary for project completion. Changes to requirements after project commencement may result in additional charges and timeline adjustments.
Communication and Feedback You agree to maintain regular communication throughout the project lifecycle, respond to our queries within reasonable timeframes, and provide timely feedback on deliverables. Delays in communication or feedback may impact project timelines and delivery dates.
Content and Materials You are responsible for providing all necessary content, including text, images, audio files, and any third-party assets required for your project. You warrant that you have the legal right to use all provided materials and that they do not infringe on any third-party intellectual property rights.
Testing and Approval You agree to thoroughly test all deliverables and provide written approval or detailed feedback within the agreed timeframe. Failure to provide feedback within the specified period will be considered acceptance of the delivered work.
4. Our Responsibilities
Professional Standards We commit to delivering services with professional skill and care, adhering to industry best practices and standards. Our team will use commercially reasonable efforts to meet agreed project timelines and quality standards.
Communication We will provide regular project updates, maintain open communication channels, and respond to your inquiries within one business day during normal business hours (Monday to Friday, 9:00 AM to 6:00 PM PKT).
Quality Assurance All developed games will undergo comprehensive testing across multiple Android devices and versions to ensure functionality, performance, and user experience standards are met before delivery.
5. Payment Terms
Pricing and Invoicing Project costs will be outlined in your Service Agreement. Unless otherwise specified, payments are structured as follows: 50% upon project commencement, 25% at project milestone (typically mid-development), and 25% upon final delivery and approval.
Payment Methods We accept payments via bank transfer, PayPal, and other approved electronic payment methods. All payments must be made in US Dollars unless otherwise agreed in writing.
Late Payments Payments are due within 15 days of invoice date. Late payments may incur a service charge of 1.5% per month on outstanding amounts. We reserve the right to suspend work on projects with overdue payments exceeding 30 days.
Refund Policy Refunds are considered on a case-by-case basis. Work completed and delivered according to agreed specifications is generally non-refundable. Any refund requests must be made in writing within 30 days of project completion.
6. Intellectual Property Rights
Client Ownership Upon full payment of all fees, you will own all intellectual property rights in the final game, including source code, custom artwork, and original content created specifically for your project. This ownership transfer occurs only after complete payment of all outstanding invoices.
Third-Party Components Some projects may incorporate third-party plugins, libraries, or assets. You acknowledge that such components remain subject to their respective licenses and terms of use. We will clearly identify any third-party components used in your project.
UnfoldTrend Rights We retain the right to use general methodologies, techniques, and knowledge gained during your project for other client work. We may also showcase your completed game in our portfolio unless you specifically request confidentiality in writing.
Confidentiality We respect the confidential nature of your game concepts and business information. We will not disclose your proprietary information to third parties without your written consent, except as necessary to complete the agreed services.
7. Project Timeline and Delivery
Estimated Timelines Project timelines are estimates based on the agreed scope and assume timely client feedback and approval at each milestone. Actual delivery dates may vary due to project complexity, change requests, or client response times.
Milestone Deliveries Projects are typically delivered in agreed milestones. Each milestone requires client approval before proceeding to the next phase. Extended delays in milestone approval may impact overall project timeline and delivery dates.
Force Majeure We are not liable for delays caused by circumstances beyond our reasonable control, including natural disasters, government actions, internet service disruptions, or other force majeure events.
8. Support and Maintenance
Included Support Each development package includes specified post-launch support ranging from 30 to 90 days, covering bug fixes and minor adjustments. Support does not include new feature development or major modifications to the original scope.
Extended Support Ongoing maintenance and support beyond the included period are available under separate maintenance agreements. Such services will be quoted separately and are subject to availability.
Third-Party Issues We are not responsible for issues arising from third-party services, app store policy changes, or Android system updates that may affect your game’s functionality after delivery.
9. Limitation of Liability
Service Limitations Our liability for any claims related to our services is limited to the total amount paid by you for the specific project in question. We are not liable for any indirect, incidental, special, or consequential damages.
App Store Approval While we follow best practices for app store compliance, we cannot guarantee approval by Google Play Store or other distribution platforms. App store rejections due to policy changes or other factors beyond our control are not grounds for refund or additional compensation.
Performance Disclaimer We make no guarantees regarding the commercial success, download numbers, or revenue generation of your completed game. Market performance depends on numerous factors beyond our control, including marketing efforts, market conditions, and competition.
10. Termination
Client Termination You may terminate a project at any time by providing 30 days written notice. Upon termination, you will be invoiced for all work completed to the date of termination, and any completed deliverables will be provided upon payment.
Our Termination Rights We reserve the right to terminate projects in cases of non-payment, breach of these Terms, or if continuation of the project becomes commercially impractical. In such cases, completed work will be delivered upon settlement of all outstanding payments.
Effect of Termination Upon termination, both parties’ obligations cease except for payment obligations, confidentiality commitments, and intellectual property provisions, which survive termination.
11. Dispute Resolution
Governing Law These Terms are governed by the laws of Pakistan. Any disputes arising from or relating to these Terms or our services will be resolved through the courts of Lahore, Pakistan.
Mediation Before pursuing formal legal action, both parties agree to attempt resolution through good faith negotiations. If direct negotiation fails, disputes may be submitted to mediation through a mutually agreed mediator.
Limitation Period Any claims arising from our services must be brought within one year of the completion of the relevant project or the discovery of the issue, whichever occurs first.
12. General Provisions
Entire Agreement These Terms, together with any Service Agreements or Statements of Work, constitute the entire agreement between the parties and supersede all prior negotiations, representations, or agreements relating to the subject matter.
Amendments These Terms may only be modified through written agreement signed by both parties. We reserve the right to update these Terms for future projects with reasonable notice to existing clients.
Severability If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be replaced with an enforceable provision that most closely reflects the original intent.
Assignment You may not assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations to affiliated companies or in connection with a merger, acquisition, or sale of business assets.
Waiver Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or our right to enforce it in the future. All waivers must be in writing and signed by the party against whom the waiver is sought.
